Terms and Conditions 

Information on how to enter forms part of these conditions. Participation in theCHRISTMAS LUXE giveaway (“Competition”) constitutes acceptance of theseTerms andConditions.

Daylesford Macedon Tourism, @daylesfordmacedonranges,CHRISTMAS LUXE giveaway is not sponsored, endorsed, or administered by, or associated with Instagram. 

Instagram users must only tag themselves or others in the comments section of the post.

    Competition Period 

    • Commences at: 00:00am (AEST) on Thursday 1 December 2022 
    • Ends at: 11:59pm (AEST) on Wednesday 21 December 2022 

    Selection of Winner(s): 

    The prize winner(s) will be drawn at random by the Promoter on Thursday 22  December 2022. The winner (s) will be contacted and notified via email. The address and telephone from the winner will be requested so the prize partners can make direct contact regarding booking the prize. When a prize winner is drawn, the winner’s name will be published on Daylesford Macedon Tourism’s Instagram account and on this website.

    IMPORTANT! PLEASE NOTE the winner will be notified by the main prize partner, Bold Jewellery ONLY. Please disregard any messages you receive about this competition from any secondary/lookalike/imposter accounts. If you do receive such a message, please do not provide credit card details, and immediately report it to Instagram. Please note our Instagram account is a creator account so please choose ‘someone I know’ when answering ‘It’s pretending to be someone else’ in reporting prompts. 

    Prizes: 

    Total prize valued $16,080

    • 9ct white gold, diamond and sapphire pendant.  Featuring a round, brilliant cut, natural sapphire, claw set, 4.35ct in weight (with dimensions 8.95 - 9.05 x 5.95mm) and light pink in colour.  15 round, single cut diamonds, approximately 0.22ct in total combined weight, SI / PI in clarity and G / H in colour.  The pendant is a total 2.06 grams in weight. 
    • $200 dining voucher to Sault Restaurant, Daylesford.

    Participation in this Competition is only open to Australian citizens and Permanent residents aged 21 years or over, with a current driver’s licence. 

    Employees of the promoter (and their immediate families), or agencies or companies associated with or connected to the provision of the Competition in any way, are ineligible to enter. 

    The promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence), and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 

    Entry 

    1. This Competition is a game of chance and will be randomly drawn by the Promoter using a random selection generator. 
    2. To enter, eligible persons must be following @daylesfordmacedonranges, @sault_daylesford and @boldjewellery_. By providing contact details entrants are affording the Promoter and their prize partners permission to send updates and information post-promotion. 
    3. Entries must be received within the Competition Period.  Entries are deemed to be received at the time they are received by the Promoter’s Instagram account. The Promoter accepts no responsibility for any late, lost, or misdirected entries due to technical disruptions, network congestion or for any other reason. 
    4. Incomplete entries will be deemed invalid. 
    5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence), and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 
    6. The cost of accessing the promotional Social Media account will be dependent on the entrant’s individual Internet Service Provider. 
    7. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries by that entrant invalid. 

                Prizes 

                1. The Winner will be randomly drawn on Thursday 22 December 2022. 
                2. The Winner will be notified in writing via email from Bold Jewellery ONLY. 
                3. All reasonable attempts will be made to contact the Winner. If the Winner fails to respond to Bold Jewellery’s message by 9:00am (AEST) Thursday January 5th 2023, the Promoter will reserve the right to select an alternative Winner. 
                4. When contacted, the Winner will be required to further confirm their agreement to these Terms and Conditions by their response. Prizes will be issued to the Winner in accordance with these conditions and subject to such confirmation. 
                5. Prizes are not transferable and cannot be taken as cash. If a prize is unavailable, for any reason, the Promoter reserves the right to substitute the prize to the equal value and/ or specification. 
                6. Prizes are to be redeemed within one year from the date of prize draw unless otherwise stated in the T&Cs via the prize providers. Winner will abide by the T&Cs of the prize provider and are responsible to ensuring they are aware of all T&Cs. 
                7. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for the change in prize value between now and the prize redemption date. 
                8. It is the responsibility of the Winner of the CHRISTMAS LUXE Giveaway to cover the costs of any additional out-of-pocket expenses associated with redeeming this prize over and above packaging and delivery. 
                9. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the Winner. 
                10. The Winner will receive the prize via the prize provider. 

                                    Competition and Consumer Act 2010 and Limitation of Liability

                                    1. The  Competition and Consumer Act 2010 (Cth), as well as other laws in Australia, may imply certain conditions, warranties and undertakings, and give you other legal rights.  If they apply, these cannot be modified or excluded by any contract.  You may consider seeking legal advice as to whether they apply to you. 
                                    2. Nothing in these Terms and Conditions generally affects the entrant’s rights under Australian consumer law (as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and equivalent State and Territory fair trading legislation) regarding consumer guarantees to the extent that such consumer guarantees cannot be excluded by law.  Other than these consumer guarantees, the Promoter makes no warranties about any prizes offered as part of the Competition, including warranties as to the quality, merchantability or fitness for purpose of such prizes. 
                                    3. The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or entrant; or (f) use of the prize. 
                                    4. All claims and entries become the property of the Promoter. By entering the Competition, each entrant is taken as consent to the Promoter using the entrant’s personal information to administer the Competition, announce the Winner and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Competition and announcing the Winner, and to third parties as required by law (including authorities that regulate this Competition). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and its Privacy Policy is available here.  An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
